This position requires a Swiss residency up-on the start of the position. /p pAs a Legal Counsel, Group Dispute Resolution (GDR), you will also be a member of the Group Dispute Resolution CIB EMEA Platform. /p h3Overview Of The Team /h3 pThe Legal department Switzerland is an integrated control function of BNP Paribas in Switzerland covering its Zurich and Geneva branches. Our team brings together qualified lawyers under Swiss, French and English law, providing legal support in French, English, German and Italian. The department comprises of legal team of 18 lawyers based in Geneva and Zurich servicing the various businesses of the bank, including a litigation team. /p h3Key Responsibilities /h3 pbYour main responsibilities in this role: /b /p pbLitigation / Pre-litigation: /b /p ul liAs a member of the Group Dispute Resolution CIB EMEA platform for Switzerland, you will be reporting to the Head of GDR CIB EMEA as your Hierarchical Manager and in liaison with the Territory Head of Legal. Your primary responsibility will be to manage, coordinate, and monitor civil pre-litigation and litigation matters (including proceedings for own account, HR, etc.), as well as administrative and criminal proceedings. /li liDevelop and deploy action or defense strategies in coordination with internal stakeholders and external counsel. /li liInteract with numerous stakeholders within LEGAL to provide advice regarding litigation risk. /li liHandle and monitor requests from judicial and administrative authorities related to the Bank's client activities. /li liParticipate in various Group committees concerning managed litigation matters. /li liContribute to the drafting of procedures and policies regarding litigation and the proactive management of legal risk. /li /ul pbLegal Advisory: /b /p ul liProtect the Bank's interests in its business relationships with clients and all third parties. /li liSupport CIB and Swiss WM business representatives (and dedicated functions) with legal advice and opinions in analysing situations and making decisions regarding the Bank's management and the conduct of business. /li /ul pbContracts: /b /p ul liProvide standardized or specific documents, as well as legal opinions, to secure contractual relationships between the Bank and its partners. /li liOffer advisory services to negotiate the best possible contractual terms. /li /ul pbRegulatory Requirements: /b /p ul liHandle and monitor regulatory matters to ensure that the Bank operates and conducts its activities in compliance with the legal framework. /li /ul pbLegal Watch: /b /p ul liIn collaboration with the Legal Watch officer, collect and distribute selected documents and instructions within the WM, CIB, and Transversal and Compliance legal departments, and relevant business lines and functions, in order to effectively and securely identify developments in Swiss and international legislation and regulation regarding international financial sanctions and embargoes. /li /ul pbCross-Border Risks: /b /p ul liParticipate in implementing and ensuring compliance with the rules established for the WM Switzerland business line regarding cross-border risk management and ensure adherence to relevant prudential rules and recommendations. /li /ul h3Guiding Principles /h3 pbContributor Role: /b /p ul liEnsure the implementation, interpretation, and application of Swiss, European, and US regulations regarding anti-money laundering (AML), anti-corruption, and countering the financing of terrorism (CFT), as well as compliance with international financial sanctions and embargoes. /li /ul pbIndependence of Judgment and Action: /b /p ul liCarry out duties with independence of judgment and action, in compliance with applicable rules and laws, in the Bank's interest. /li liCritically analyse legal issues. /li /ul pbDocumentation and Reporting: /b /p ul liDocument the exercise of responsibilities in order to keep records and be able to justify them to auditors and regulators. Report formally to the Hierarchical Manager as well as to the Head of Legal for the Swiss Territory. /li /ul pbRole as Guarantor of the Bank's Legal Security: /b /p ul liThis role comes with a duty to alert your Hierarchical Manager of any malfunction or issue likely to create legal risks and/or involve the Group's reputation, and, where applicable, to alert the Head of Legal for the Swiss Territory regarding legal and/or reputational risks concerning the Swiss Territory. /li liContribute to ensuring the legal security of the Bank's corporate life. /li /ul pbKey Performance Indicators (KPIs): /b /p ul liImplementation status of tasks and actions under responsibility. /li liReporting on significant matters, litigation, and pre-litigation. /li liQuality and risk indicators. /li /ul pYou will work in a dynamic, multicultural and international environment.
