KuCoin EU is looking for a
Senior Legal Counsel – Product & Regulatory
to support the development and operation of its regulated business across the European Economic Area (EEA).
This role will focus on
financial services regulation, crypto-asset regulation, product legal advisory and regulatory matters . You will work closely with Product, Business, Operations, Technology and senior management to assess new products and business initiatives, identify regulatory requirements and risks, and develop practical, commercially viable solutions within the applicable regulatory framework.
The ideal candidate combines strong legal and regulatory expertise with a
practical, solution-oriented approach , and is comfortable independently analysing complex products, navigating overlapping regulatory requirements and providing clear advice to business stakeholders.
The role will work closely with the
Management Board, Product, Business Operations, Operations and other group functions , as well as external legal advisers and regulatory authorities where appropriate.
Key Responsibilities 1. Product & Business Legal Advisory
Act as a key legal adviser to Product and business teams on new and existing products, services and business initiatives.
Conduct legal and regulatory assessments of proposed products, features, business models and operational structures.
Provide legal guidance throughout the product lifecycle, from initial concept and structuring through launch and post-launch review.
Identify regulatory requirements and potential legal risks at an early stage, and propose practical and commercially viable solutions.
Work closely with Product, Technology and Operations teams to translate legal and regulatory requirements into practical product and operational requirements.
Provide clear, actionable recommendations to support informed business decisions.
2. EU Financial Services & Regulatory Advisory Provide legal advice on EU and relevant national financial services regulations applicable to KuCoin EU, including but not limited to:
Markets in Crypto-Assets Regulation (MiCAR);
MiFID II;
PSD2 / EMD2;
Digital Operational Resilience Act (DORA);
Other EU and national financial services legislation relevant to KuCoin EU's regulated activities.
Analyse regulatory requirements where multiple legal and regulatory frameworks may apply.
Monitor relevant regulatory developments and assess their potential impact on products, services and business operations.
Translate regulatory requirements into practical guidance for business and product stakeholders.
3. Licensing & Regulatory Engagement
Support and, where appropriate, lead licensing and authorization-related matters for KuCoin EU.
Provide legal support for regulatory engagement with the
Austrian Financial Market Authority (FMA)
and other relevant European regulatory authorities.
Advise management on regulatory considerations and potential approaches to new business activities and products.
Coordinate with internal stakeholders and external counsel on regulatory submissions, inquiries and other regulatory matters.
4. Commercial, Contractual & Legal Support
Draft, review and negotiate legal documentation relating to products, platforms, commercial arrangements and business activities.
Support contractual matters involving outsourcing, intra-group arrangements and other regulatory-sensitive structures.
Provide legal input on commercial structures where regulatory considerations are material.
Work with external counsel and specialist advisers where additional expertise is required.
Candidate Requirements
Qualified lawyer in an
EU/EEA jurisdiction, the UK or another recognised common-law jurisdiction .
Typically
5–8+ years of post-qualification experience (PQE)
in a relevant legal or regulatory role. Exceptional candidates with a different level of experience may also be considered.
Strong experience in
financial services regulation, fintech, payments, digital assets/crypto or other highly regulated financial sectors .
Demonstrable experience providing legal advice on
products, business models and regulatory matters .
Strong understanding of EU financial services regulatory frameworks, with experience in
MiCAR and/or other relevant EU financial regulations
highly valued.
Experience with licensing, regulatory engagement or working with financial regulators is highly desirable.
Excellent legal research, analytical and problem-solving skills, with the ability to assess complex regulatory issues and provide practical recommendations.
Strong commercial awareness and ability to balance legal and regulatory requirements with business objectives.
Ability to work independently and manage multiple matters involving cross-functional and senior stakeholders.
Excellent written and spoken English.
Nice to Have
Previous experience with a financial regulator, financial services law firm, regulated financial institution, fintech company or regulated digital-asset business.
Experience working in a fast-paced, international and cross-functional environment.
Experience advising on products or business models involving multiple or overlapping regulatory frameworks.
Familiarity with the Austrian or broader European regulatory environment.
